DUID (Driving Under the Influence of Drugs)

“DUID is essentially the same thing as a DUI, which is indistinguishable from DWI under the Virginia Code. But DUID is Driving Under the Influence of Drugs. Marijuana in particular has no “per se” concentration that says if a certain amount is in your blood, then you are ‘under the influence’. Other schedule I/II drugs have these concentrations, but most familiar to everyone is the 0.08 blood alcohol level. While many defense attorneys have been successful arguing that no specific quantity of THC found in one bloodstream is indicative of driving under the influence, it seems that Congress is pushing for something that will eliminate the grey area. While this article is regarding Colorado and Virginia may be years away from legalizing marijuana like some of her sister states, there is a trickle effect which we must always be mindful of.
